Actor Daniel Stern, best known for his role as Marv in Home Alone, was officially charged with one misdemeanor count of soliciting prostitution on Monday (January 12), according to Supreme Court of California--County of Ventura online records.

The alleged incident took place on December 10 and Stern is scheduled for arraignment on Tuesday (January 13), the records confirmed. The actor was cited at a motel in Camarillo, California, a Ventura County District Attorney spokesperson Joey Buttitta confirmed to PEOPLE.

“From what I understand, he was cited at the location and released,” Buttitta said.

Stern's December citation was initially reported by TMZ over the weekend, with the outlet specifying that the actor wasn't arrested at the time. Soliciting a prostitute is a misdemeanor and a conviction can carry a sentence of up to six months or a $1,000.

Stern was previously reported to be hospitalized after suffering a medical emergency in October. The actor played Marv Murchins, one of the two 'Wet Bandits' alongside Joe Pesci, in the original Home Alone released in 1990 and its sequel, Home Alone 2: Lost in New York, released in 1992.

Stern also starred alongside Billy Crystal and Bruno Kirby in the film City Slickers and played fictional Chicago Cubs pitching coach Phil Brickma in Rookie of the Year. The 68-year-old has since moved away from Hollywood, telling PEOPLE in 2024 that he's enjoyed a life on his California ranch with his wife, Laure Mattos, the mother of his three children.

“I made enough money that I didn’t have to work,” he said. “I made enough money and I’m kind of frugal … I bought the house in cash. I bought the cars in cash. I bought everything straight up because as an artist, I never knew if [I was] going to make any more bread. And I said to my wife, ‘How much money do I need to sock in the bank so that we can live off the interest and so that I don’t have to work?’ She said, ‘We hit it.'”
